These Terms and Conditions ("Terms") govern your use of the SwapYrd mobile application ("App", "Service") operated by SwapYrd ("we", "us", or "our"). By creating an account or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use SwapYrd. By using the App you represent and warrant that you meet this requirement. We do not knowingly collect information from anyone under 18. If we discover that a user is under 18 we will terminate their account immediately.
Registration. You must create an account to post listings or contact sellers. You agree to provide accurate, current, and complete information and to keep it up to date.
Security. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@swapyrd.app if you suspect unauthorised access.
One account per person. You may not create multiple accounts or transfer your account to another person.
SwapYrd is a platform that connects individuals who wish to sell, trade, or give away personal property at yard sales or as individual items. We are not a party to any transaction between users and do not buy, sell, or exchange any items ourselves.

All transactions are conducted entirely between buyers and sellers. You transact at your own risk.
Your content. When you post a listing, photo, review, or any other content ("User Content") you grant SwapYrd a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute that content solely for the purpose of operating the Service.
Accuracy. You are solely responsible for the accuracy and completeness of your listings. Listings must describe the item truthfully, including any defects.

SwapYrd facilitates connections between users; all exchanges happen in person. You are solely responsible for your own safety. We strongly recommend:
SwapYrd is not responsible for any harm, loss, injury, or dispute arising from an in-person meeting or transaction between users.
Users may leave reviews for one another after a transaction. Reviews must be honest, first-hand, and relate to the actual transaction. You may not:

The SwapYrd name, logo, and all original content, features, and functionality of the App are owned by SwapYrd and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWAPYRD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR ANY TRANSACTION CONDUCTED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).
You agree to indemnify and hold harmless SwapYrd and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App, your User Content, your violation of these Terms, or your violation of any rights of another person.
We may suspend or terminate your account at any time, with or without cause, with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the Service ceases immediately. Sections 8–13 survive termination.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.
Informal resolution. Before filing any claim, you agree to contact us at support@swapyrd.app and attempt to resolve the dispute informally for at least 30 days.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and, for material changes, notify you via the App or by email. Your continued use of the App after the effective date constitutes acceptance of the revised Terms.
